1. Acceptance of Terms

By accessing or using ShutterShield ("the Service"), operated by Obsidian Clad Labs LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ShutterShield is a photo editing and client gallery platform designed for professional photographers. The Service provides bulk photo editing powered by GPU processing, film filter emulations, style matching, object removal, and client-facing gallery pages with download and delivery options.

3. Photo Ownership

By uploading photos to ShutterShield, you grant us a limited license to process, store, and display your photos solely for the purpose of providing the Service to you. This license terminates when you delete your photos or your account.

4. Data Processing

Photos are processed on secure GPU servers. During processing, photos are held in memory on the processing server and are deleted from processing memory after completion. Processed photos and originals are stored in your account until you delete them. Gallery photos are accessible only to you and anyone you explicitly share them with via gallery links.

5. User Accounts

• •You are responsible for maintaining the security of your account credentials
• •You must be at least 18 years old to create an account
• •One person per account unless on a Team plan
• •We reserve the right to suspend or terminate accounts that violate these terms

6. Acceptable Use

You agree NOT to:

• •Upload content that is illegal, harmful, or violates third-party rights
• •Use the Service to host or distribute content you do not have rights to
• •Attempt to reverse-engineer our processing algorithms or AI models
• •Use automated tools to make bulk requests that exceed normal usage patterns
• •Share gallery links publicly if the content is intended to be private
• •Interfere with or disrupt the Service or its infrastructure

7. Subscription Plans and Billing

• •Free plan: 50 images per month, 3 galleries, no payment required
• •Paid plans: Billed monthly or annually via Stripe
• •You may cancel your subscription at any time from your settings
• •Cancellation takes effect at the end of the current billing period
• •30-day money-back guarantee on all paid plans, no questions asked
• •We reserve the right to modify pricing with 30 days advance notice

8. Refund Policy

All paid plans include a 30-day money-back guarantee. If you are not satisfied within 30 days of purchase, contact us for a full refund. No questions asked. After 30 days, refunds are available on a prorated basis for annual plans. Monthly plans are not refundable after 30 days but can be cancelled at any time.

9. Intellectual Property

ShutterShield, including its name, logo, design, code, AI models, and film filter algorithms, is the intellectual property of Obsidian Clad Labs LLC. You may not copy, modify, distribute, or create derivative works without our written permission. Your photos, gallery content, and account data remain yours.

10. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted access. GPU processing times may vary based on demand. We may modify, suspend, or discontinue features with reasonable notice. We will provide at least 30 days notice before discontinuing the entire Service.

11. Limitation of Liability

To the maximum extent permitted by law, Obsidian Clad Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or revenue, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Obsidian Clad Labs LLC from any claims, damages, or expenses arising from your use of the Service, the content you upload, violation of these terms, or infringement of any third-party rights.

13. Governing Law

These Terms shall be governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Tennessee.

14. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance.
